Will of John Osborn

In the name of God, Amen, I John Osborn of the County of Greenbrier and State
of Virginia being in perfect sense and memory & knowing that it is appointed
for all men once to die do hereby make and ordain this my last will and
Testament in manner & form following to wit:
Imprimis.  It is my Will & desire that my son James Osborn should have that
part of the tract of land on which I now live that is bounded as follows to
wi begining at a white oak on William Feamster's line & corner with Richard
Humphreys thence along said Humphreys line to Viney's line thence along
Viney's line to a black oak & hickory marked as a corner, thence a straight
line to a black locust & white oak standing in my son David Osborne's line
thence along my son David Osborne's line to Feemster's line thence along
Feemster's line to the begining the above tract of land I give to my son
James Osborne provided he pays to my son John Osborne or his heirs one
hundred & twenty pounds in trade at trade rates in two years after my decease
& to him & his heirs and assigns forever in case he pays the aforesaid sum
I give & bequeath the same.
Item.  It is my will & desire that my son Joseph Osborn should have the tract
of land on which he now lives bounded as follows to wit: Begining at a black
oak and hickory marked as a corner & standing in Viney's line thence along
Viney's line to Samuel Kinkead's line thence along Kinkead's line to David
Osborne's corner thence thence<sic> a straight line to the begining the above
tract of land I give to my son Joseph Osborn provided he pays to my daughter
Huldah Kinkead or her heirs twelve pound in trade at trade rates in two years
after my decease & to him & his heirs & assigns forever in case he pays the
aforesaid sum I give & bequeth the same.
Item.  It is my will & desire that my son Jeremiah Osborne shoud have that
part of my tract of land on which he now lives including the whole of my land
lying above the tract I gave to my son David Osborne provided he pays to my
daughter Huldah Kinkead twelve pounds in trade at trade rates in two years
after my decease & to him my said son Jeremiah Osborne & to his heirs &
assigns forever in case he pays the aforesaid sum I give devise & bequeath
the same.
Item.  I give, devise & bequeath to my son Elijah Osburn ten shilling to be
paid to him by my executors hereafter mentioned out of my personal estate as
to my son David Osborne I have already given him his portion, in the land on
which he now lives.
Item.  I give devise & bequeath to my son John Osborn & his heirs forever one
hundred & twenty pound to be paid to him in trade at trade rates by my son
James Osborn in two years after my decease.
Item.  I give, devise & bequeath to my son Levi Osborn one hundred & twenty
pound to be paid him by son David Osborn agreeable to an article of agreement
between my son David & myself for that purpose & to him & his heirs forever I
give, devise & bequeath the same.
Item.  I give & bequeath to my daughter Huldah Kinkead twenty four pound to
be paid to her or her heirs two years after my decease in trade at trade
rates by my sons Jeremiah Osborn & Joseph Osborn & to her & her heirs
forever, I give & bequeath the same.
Item.  I will that my executors hereafter mentioned sell the whole of the
residue of my estate including a tract of land containing four hundred acres
lying on Kanawha Road & all my personal estate & that my just debts & funeral
expenses be paid out of the money arising from said sales.  It is also my
will & desire that there shoud be no inventory or appraisement of my estate,
but that the balance after paying my just debts & funeral expences shoud be
equally divided among my five daughters Sarah Alderson, Elizabeth Dunbar,
Jane Osborn, Huldah Kinkead & Deborah Osborn & to them & their heirs forever
I give devise & bequeath the same.
Lastly.  I constitute and appoint my sons James Osborn, David Osborn and
Joseph Osborn executors of this my last will & testament hereby revoking all
former wills by me made & confirm this alone to be my last will which I seal
publish & declare this fifth day of May in the year of our Lord one thousand
eight hundred & five.

At a Court held for Greenbrier County the 29th day of July 1806.  This last
will and testament of John Osbon dec'd was proved by the oaths of Robert
Harrah, James Humphress, and James Pane witnesses thereto and ordered to be
recorded and on the motion of James Osborn, David Osborn and Joseph Osborn
the executors therein named who made oath thereto and together with Richard
Wilson, Robert Harrah and Samuel Kincaid their securities entered into and
acknowledged their bond in the penalty of $1000 conditioned as the law
directs certificate is granted them for obtaining a probate thereof in due

In the name of God Amen
The thirty first day of July in the year of our Lord one thousand seven
hundred and eighty three, I George Osborn of Hampshire County and State of
Virginia, farmer, being very sick and weak in body, but of perfect mind and
memory, thanks be to God.  Therefore calling to mind the mortallity of my
body and knowning that it is appointed for all men once to die, do make and
ordain this my last will and testament.  That is to say principally and first
of all I give and recommend my soul into the hands of God that gave it and
for my body I recommend it to the Earth to buried in a Christion like and
deacent manner at the discreation of my executor nothing doupting but at the
general Reserection, I shall recieve the same gain by the mighty power of
God.  And as touching sutch worldly estate where with it hath pleased God to
bless me in this life, I give devise and dispose in the following form and manner
in the first place I desire all my lawful debts to be paid.  I give and
bequeath unto Hannah my derely beloved wife the third part of moveable estate and
third part of the plantation I now live on all to be kept in the hands of my
executor to be delt out by him to her as her need shall require and if anything
of her part be left at her deceas it is to be equally divided amonguest all
beloved sons and daughters -- I give and bequeath to my well beloved son
Josiah Osborn whom I likewise constitute make and ordain my onely and sole
executor of this my last will and testament the whole of my plantation I now
live on containing two hundred and twenty acres by him freely to be possed
and enjoyed by him his heirs executors and assigns forever he paying the rest
of my well beloved sons and daughters there part.  I likewise will to my
well beloved sons Isaac and Solomon Osborn my plantation on Rackoon Creek
containing one hundred and sixty acres to them their heirs executors and
assigns forever they paying their part, also I will that all my moveables
goods and chattles be gathered and apraised at the full value and except
sutch as my well beloved sone Josiah shall see cause to keep at the
apraisement to be sold at publick sale.  I likewise leave my well beloved son
Solomon the mare he now calls his over and above his part with his sheep.
Likewise I give my well beloved son Francis the colt he mow<sic> calls his
over and above his part.  Likewise I leave my children all under age to the
discreation of my executor to be bound or not bound by him.  Likewise I give
to my grandsone George Osborn a mare colt now sucking.
And I do hereby utterly disalow revoke and disown all and every other former
testaments wills legisies and executors by me willed and bequeathed ratifying
and confirming this and no other to be my last will and testament
of which I have made my well beloved son Josiah Osborn sole executor
in witness whereof I have set my hand and seal.

At a Court held for Hampshire County the 11th day of November 1783.
This last will and testament of George Osborn dec'd was presented in Court
by Josiah Osborn the executor within named proved by the oaths of John
Harris & Simeon Harris witnesses thereto &  produced to be recorded and on
the motion of the the said the said<sic> executor who made oath according to law,
certificate is granted him for obtaining a probate thereof in due form giving

In the name of God amen,
   I, George Osborne of the County of Kanauha, and State of West Virginia,
nowing<sic> that it is appointed for all men once to die, do make this my
last Will and Testament in manner and form, that is to say,

1st, I give unto my three sons namely, Harvey, George and William H., my two
tracts of land on on<sic> Sandy, (Harvey to have the upper end of the old
tract on the Creek where he now lives) William H. to have the lower end with
the house I now live in, the above lands to be equally divided, with this
proviso, they the above named Harvey, George and William H, shall pay to my
daughter Caroline, the sum of one hundred and fifty dollars,

2nd, I give unto my daughter Mahala Cart, wife of Richard D. Cart my tract
of land on Wills Creek, it being the same bout of Karns, and where Richard
Cart now lives the said Mahala Cart, and her heirs, in her own rite to have
and to hold with all its appurtenances forever,

3rd, After all my funeral expenses is paid, my personal property shall be
or divided so as to give all my heirs an Equal Share, with the exception of
David Osborne's heirs, having given David the place where thy now live,
considered to be his Share,

In Witness whereof I have hereunto Set my hand and Seal this 10th day of
February 1868

At a Circuit Court held for Kanauha County, at the Court House thereof, on
the 6th day of October 1868,
   This paper writing purpoting<sic> to be the Last Will and Testament of
George Osborne dec'd, who departed this life on the 10th day of August last,
was this day presented to the Court, and offered for probat<sic>, and it
being proved by the oaths of Melton Woods and John Kennedy, that the said
writing, together with the signature thereto is the proper hand writing of
deceased throught, it is ordered that the said writing be recorded as and
for the last Will and Testament of the said decedant
