John Osborn land deed, 1791 Bedford Co., PA

The following is an transcription of a deed from Bedford County,
Pennsylvania.  The actual document is dated 1790 and recorded in
1791, Deed Book C, Page 391, and is on LDS film 331,371.

Osborn to Woodcock

This Indenture made the sixth day of the eleventh month in the year
of our Lord one thousand seven hundred and ninety.  Between John
Osborn of Bedford County and State of Pennsylvania (illegible but
from the context it appears to be a profession, possibly
"Apoman"?) of the one part and Bancroft Woodcock of the
Burrough of Wilmington in the Delaware State Goldsmith of the
other part.  Whareas (sic) the said John Osborn by virtue of an
Indenture of Bargain and Sale duly executed under the hand and
Seal of the said Bancroft Woodcock and Ruth his wife for the
consideration therein mentioned became lawfully seized in fee of
and in a certain tract of land situate lying and being in Wells Valley
Bedford County of State of Pennsylvania and Bounded as followith,
to wit.  Beginning at a marked Grub(?) on a rocky face at a small
run thince by sidling hill South twenty and a half west two hundred
and fifteen perches(?) to a poste being also the corner of Charles
Whitlock's heirs Land & which was struck off this tract thence with
that line West one hundred & sixty four perches & six tenths to a
poste thence with Michael Grosses Land North one hundred and
eighty eight perches & seven thnths to a poste, thence East two
hundred & sixty eight perches to a marked Grub(?) & place of
Beginning containing two hundred and fifty five acres and sixteen
perches of Land be the same more or less together with the
appertioancies(?) as by the said Indenture writing
as is therin recited barcing(?) date the next day before the date of
these presents performance thereunto being had may fully appear.
And (illegible) the P John Osborn have executed under his hand &
Seal. Seven obligations unto the P Bancroft Woodcock to wit
Number one for the Just and full sum of eighty two pounds five
shillings current money of the
State of Pennsylvania conditioned for the delivery of two hundred
and fourteen bushels of good merchantable wheat weighing sixty
pounds per Bushel & that on or before the first day of the ninth
month in the year of our Lord one thousand
seven hundred and ninety two.  Number two for the Just and full
sum of seventy nine pounds five shillings current money aforesaid,
Conditioned for the delivery of one hundred and ninety
eight bushels of like wheat aforsaid on or before the first day of the
ninth month in the year of our Lord one thousand seven hundred
and ninety three.  Number three for the Just and full sum of eighty
two poundsfive shillings conditioned for the delivery of two hundred
and fourteen bushels of like wheat aforsaid on or before the first
day of the ninth month in the year of our Lord one thousand seven
hundred and ninety four.  Number four for the Just and full sum of
eighty two poundsfive shillings conditioned for the delivery of two
hundred and fourteen
bushels of like wheat as above on or before the first day of the ninth
month in the year of our Lord one thousand seven hundred and
ninety five.  Number five for the Just and full sum of eighty two
poundsfive shillings conditioned for the delivery of two hundred and
fourteen bushels of like wheat aforesaid on or before the first day of
the ninth month in the year of our Lord one thousand seven
hundred and ninety six.  Number six for the Just and full sum of
eighty two pounds five shillings conditioned for the delivery of two
hundred and fourteen bushels of like wheat abovesaid on or before
the first day of the ninth month in the year of our Lord one thousand
seven hundred and ninety seven.  Number seven for the Just and
full sum of eighty two pounds twelve shillings and six pence
conditioned for the delivery of two hundred and sixteen bushels of
wheat as abovesaid on or before the first day of the ninth month in
the year of our Lord one thousand seven hundred and ninety eight.
Now this Indenture Witnesseth that the said John Osborn for and in
consideration of the better securing the abovesaid one thousand
four hundred & eighty four bushels of Wheat agreeable to theP
seven obligations if as will for and in consideration of five shillings
money aforesaid to him in hand paid
at or before the (illegible) of delivery of (illegible) presents by the P
Bancroft Woodcock the receipt whereof is hereby
acknowledgid (sic) he the said John Osborn Hath granted
bargained and sold (illegible) released and confirmed and by these
presents doth grant bargain and sell (illegible) release & confirm
unto the said Bancroft Woodcock his
heirs ans assigns all the above mentioned and discribed tract of
Land as the same is above discribed or the same more or less.
Together with all and singular the rites, liberties privilages (sic).  (I
don't know what the next nine words mean and can't quite decifer
the spelling) belonging or in any wise appertaining, if the (illegible)
and (illegible) remainder and remainders (illegible) (illegible) and all
the estate right title Interest property claim & demand of the  John
Osborn of his heirs of in and
to the same, if of in and to every part thereof with all deeds writings
evidences, count rolls touching or concerning the same.  To have &
to hold all and singular the (?) tract of parcil of Land (illegible) &
(illegible) hereby bargained & sold or mentioned or inland so to be
and every part thereof with the appertinoncies(?)  unto the P
Bancroft Woodcock his heirs and assigns to the only proper use
and behoof(?) of the P Bancroft Woodcock his heirs and assigns
forever.  Provided always nontheless & it is the true intent &
meaning of the Grantor & Grantee & of these presents, that if the
said John Osborn his heirs Executors Administrators of Assigns
shall well and truly pay or cause to be paid unto the said Bancroft
Woodcock his Executors Administators or Assigns, the aforesaid
one thousand four hundred & eighty four Bushels of wheat as is
above set forth at the particular stated times agreeable to the above
seven obligations, withour fraud or further delay, that then their the
above obligation of this present Indenture shall be void and of none
effect, & the estate
thereby grantedthereby granted shall cease and (illegible) this P
Indenture or any thing contained to the contrary in any wise
notwithstanding.  In Witness whereof the P John Osborn hath
hereunto set his hand and Seal and dated the day of year first

that this transcription is 100% correct.  This is obviously a
purchase of land from Bancroft Wookcock by John Osborn on Nov.
6, 1790.

This mortgage appears to have been paid off on time for the
following is an transcription of a deed from Bedford County,
Pennsylvania.  The actual document is dated 1798 and recorded in
1809, Deed Book G, page 784, and is on LDS film 331,374.

Rees to Osburn

Articles of Agreement made and concluded on this thirtieth day of
August in the year of our Lord one thousand seven hundred and
ninety eight, with and between Abel Rees of the State of
Keantuckey (sic), Mason County of the one part and John Osburn
Senior of Hopewell Township, Bedford County and State of
Pennsylvania of the other part.  Witnesseth that the P Able Rees
doth hereby agree and sign over all his right title claim interest and
demand of in and to one hundred acres of land warranted in the
names of Bancroft Woodcock and William Wright and assigned to
Daniel Rees, in Wills Valley Hopewell Township to John Osburn
Senior for the sum of forty pounds current money of the State of
Pennsylvania, likewise said Rees binds himself his heirs Executors
and Administrators in the penal sum of five hundred pounds lawful
money of Pennsylvania for to promise a lawful conveyance from
Daniel Rees Junior and Agnes Rees of their right title property and
claims in and to the same and every part thereof.  Daniel Rees
conveyance for to be completed by the last day of January 1799
Agnes Rees hers for to be completed in five years from the date
thereof likewise P John Osburn binds himself his heirs Executors
and Administrators for to pay the P forty pounds in five years from
the date hereof if P Rees complies with and fulfills his part of P
agreement, and for the true performance hereof each of the parties
bind themselves their heirs Executors and administrators in the
penal sum of five hundred
pounds lawful money of Pennsylvania, as witness our hands and

The following is from the deed books and orphans court records of
Bedford County, Pennsylvania.


Osborn. Christopher Estate.             Bedford County
Writ of Partition

The Commonwealth of Pennsylvania to the Sheriff of Bedford
County Greeting whereas Wesley Osborn, Son and heir of
Christopher Osborn, late of West Providence Township Bedford
County deceased did present his petition to our Orphans Court
setting forth that the said Christopher Osbourn died on the 27th
day of September 1872 Intestate leaving to survive him a widow
Mary Osborn and issue as follows viz:  1st Benjamin Osborn a son
residing in Beaura County, Illinois.  2nd Christopher Osborn a Son,
3rd John A. Osborn a son, both of whom reside in Decatur County,
Iowa.  4th Able G. Osborn, a son  residing in Johnson County,
Iowa, 5th Catherine a daughter intermarried with JW Whitehead,
6th Wesley Osborn a Son petitioner residing in Bedford County
Pa., 7th Anna Maria daughter intermarried with William Kneger who
reside in Mifflin County, Pa., 8th five grandchildren, who are the
issue of his deceased Son Jacob Osborn to wit:  John W.,
Christopher C., Franklin, Silas, and Mary Etta.  The last three of
whom are minors and have Guardian.  These five reside in Decatur
County, Iowa.  9th Also three other grandchildren who reside in
Bedford County, Pa and who are the issue of his deceased Son
Peter Osborn, whose names are James Irvine, Sarah J. and Emily
Ann.  All of whom are minors & have no guardian except James
Irvine who has for his Guardian C. S. Elliott Esq.  10th  Also six
other grand children who are the issue of his deceased daughter
Jane intermarried with J.R. Edwards whose names are John W.
Edwards, Thomas Edwards, Mary M. Edwards, Eveline Edwards
who reside in Bedford County, Pa, Elias Edwards residing in
Buckingham County, Virginia, and Christopher Edwards residing in
Blair County, Pa.  All of whom are minors Except John W. and
have no Guardian.  That the said decedent died seized  in fie of and
in a certain messuage or tract of land situate in west Providence
Township, Bedford County.  Adjoining lands of Samuel French,
Daniel Ritchey, Jacob Roush, and John Cook.  Containing one
hundred and thirty acres, be the same more or less, and praying
the Court to make an Inquest to make partition of the said Real
Estate, to and among, the aforesaid parties according to their
respective rights.  We therefore command you that taking with you
twelve free honest and lawful men of your bailwick you go to the
premises aforesaid and then upon their Oaths and affirmation in the
presence of the parties by you to be warned if upon being warned
they will be present, the aforesaid premises having respect to the
true value thereof into ten equal parts you cause to be parted and
divided.  If the same can be so parted and divided, without
prejudice to or spoiling  the whole thereof and one of the said equal
parts unto the said Benjamin.  One other of the said equal parts
unto the said Christopher Osborn.  3rd  one other of the said equal
parts unto the said John A. Osborn, one other of the said equal
parts unto the said Abel G. Osborn.  One other of the said equal
parts unto the said Catharine.  One other of the said equal parts
unto the said Wesley.  One other of the said equal parts unto the
said Ann Maria.  One other of the said equal parts unto the said
heir and lenial decendants of Jacob Osborn deceased.  One of the
said equal parts unto the heir and Lenial decendants of the said
Peter Osborn dec'd.   And one of the said equal parts unto the said
heirs and lenial decendants of Jane Osborn a deceased daughter
who was married with J.B. Edwards to hold to their in severalty
your assign and deliver.  And that imediately thereafter you cause
full seizure of the one third part of said premises to be delivered to
the said widow.  But if the said Inquest cannot make such partition
of the lands as aforesaid without prejudice or spoiling the whole
thereof, that then you cause the said Inquest to inquire and
ascertain, wether the premises aforesaid will accommodate two or
more of the said heirs without prejudice to or spoiling the whole
thereof.  And if they do so find, that they described each share by
meters and bounds.  And make a just and separate valuation and
appraisement thereof.  But if in case of such partition cannot be
made of premises aforesaid without Prejudice to or spoiling the
whole thereof that then you cause the said Inquest to value and
appraise the same together .  And undivided, and that partition or
valuation so made you distinctly and openly have Before our
Judges of the Orphans Court of Bedford County at Bedford on the
4th Monday of April 27th  day next under your hands and seals and
under the hands and seals of those by whose oaths and Solemn
affirmations you should have made that partition or valuation and
have you then and there this Writ Witness the Honorable William
H. Hall, Esquire President of our said Court at Bedford this 7th day
of March AD 1874.

Inquisition || Bedford County SS

An Inquisition indented and taken at West Providence Township in
the County aforesaid this seventeenth day of April AD one
thousand eight hundred and seventy four before Henry Clay
Lashley, Esq., high Sheriff of Bedford County aforesaid by the
oaths and affirmations of the Jurors whose names and seals are
hereunto annexed.  Good and lawful men of my bailwick who say
upon their oaths and affirmations that having been taken by the
said Henry Clay Lashley Esquire High Sheriff as aforesaid in his
proper person to the premises in the writ to this Inquisition annexed
described and the parties in the said writ named having been
severally named as may as chose being present.  That the
property described in the said writ cannot be parted and divided
without prejudice to or spoiling the whole thereof.  And therefore
that they value and appraise the said tract of land containing one
hundred and forty five acres and one hundred and thirty eight
perches at and for the sum of nine dollars and seventy cents for
each and every acre amounting in the aggregate to the sum of
fourteen hundred and fourteen dollars and eight six cents $1414.86.
 In testimony where of as well I the said Sheriff as the jurors
 aforesaid to this Inquisition have fixed our hands and Seals the day

Part B contains 21 acres & 60 purches  net surveyed in a warrant
to Stephen French dated the 29 of April 1837.  Connected & copied
for the Purz of Christian Osborn the 24 April 1874.
