John Osborn-11459 left a will, but this will is lost, misplaced, or discarded and is not in the Suffolk Co., MA probate records. The distribution of his estate (or a part of his estate) recorded in Suffolk Co., MA Probate Vol. 72, page 470, mentions that John Osborn-11459's eldest son John-11469 had died before him and his share of the estate was a lapsed legacy and to be treated as intestate estate. John Jr.'s share was divided among the five remaining heirs.

John Osborn-11459's sons Woodbery and Jeremiah seem to have died even before John wrote his will -- they are not mentioned in the distribution at all, meaning that they did not have any children (at least still alive in 1773) of their own.

John Osborn-11459's son Samuel is mentioned in the distribution as being deceased, but his "legal representatives" received a 2 sixth parts share as Samuel was the only son remaining with his own heirs. (At that time in Massachusetts, the eldest son received a two parts share compared with the other children receiving a one part share.)

Newport Co., RI Inferior Court of Common Pleas record book B, page 634 contains record of a case John Osborn Esq. and Thomas Oxnard merchant, both of Boston vs. Leonard Cozzens. John Osborn-11459's daughter Sarah married a Thomas Oxnard. I believe this record is good circumstantial evidence that Hon. John Osborn, Esq. appearing in various Boston records is the same person as John Osborn-11459.

The published marriage records for Boston identify John Osborn-11459's last wife as "Mrs." Elizabeth Pierce. Elizabeth (Pierce) Osborn's will, however, states that before marriage she was Elizabeth Pierce, singlewoman.
