William Osborn Will Dated may 5 1840, probated May 1841

My property, both real and personal, to my beloved wife, Susanna Osborn,
during her life, should she so long remain my widow.
I give and bequeath to my son James or to his heirs, one dollar; to my son
Squire or his heirs, one dollar; to the heirs of my son Morgan, one dollar;
to my son Hiram or his heirs, one dollar; to son William J. one dollar; to
son Manoah, or his heirs, one dollar; to daughter Sally White, or her heirs,
one dollar; to the heirs of Daugter Susannah Bradshaw, one dollar; to
daughter Betsy Gray, or her heirs, one dollar; to daughter Clementine Goad,
one dollar.

After the death or marriage of my wife, Susannah, I give and bequeath unto my
two step-sons, frances P. Shrode and Pannenus C. Shrode, children of my
present wife, Susannah, and my two youngest children, Potipher and Azenith
all the land I now own in the county of warrick, to be devided among them. My
personal property unto my two youngest sons, but in case opf their death
without issue, their shares of both real and personal property to descend be
devided among my legal and lawful heirs.

I hereby conbstitute and appoint my friend John B. Welt my executor of this
last will and testement

County of Warrick

On this seventeenth day of September, 1832, personally appeared in Open Cpurt
before the judges of the Warrick Circuit Court of the County of Warrick of
the County and State aforesaid now sitting William Osborn, a resident of the
County of Warrick and the State aforesaid, aged sixty nine years, who being
sworn according to law, doeth , an his oath, make the following declaration
in order to pbtain the benifit of an act of Congress passed June 7, 1832,
that he entered the service of the United States in the State of North
Carolina, Rowan County, Drafetd at the age of Fifteen by consent of his
father for three months. Served the term of three months in Col. Fifer's
(Phyfer's) Regiment, General Green Command west from Rowan County into
Meclinburg County. The next tour was as a volunteer under Capt. Neighton from
Rowan County, Colonel Co;well and General Retherford commanded, served three
months, discharged by Capt Neighton. On our return we fired on the tories in
Randolph County, they run, belonged to the light mounted infantry. In the
next place, he was substituted for twelve months, emloyed by Major Peirson to
serve for some other person, does not recollet the name of the person. Served
under Major Langham and was dicharged by him at the expiration of the time.
Was called out on a number of other occasions and does not recollect the
length of each or any of the periods and that he has no document in his
possession nor does he at this time knbow of anyone whereby he could prove
his services by at this time.
He hereby relinquishes every claim whatsoever to a pension or annuity except
the present and declares that his name is not on the pension Roll of the
agency of any State or Territory within the United States.

We, Abner Luce and James C. Graham, residing in the County of Warrick and the
State of Indiana, hereby certify that we are well acquainted with William
Osborn who has subscribed and sworn to the above declaration that we believe
him to be of the age of sixty nine years that he is reputed andbelieved, in
the nieghborhood where he resides, to have been a soldier of the Revolution
and that we concur in that opinion.

Whereupon the Court propounded the following interogation to which the said
William Osborn made the followin answers upon oath, viz.

1. When and in what place were you born?

   I was born in the year of sixty three in Rowan County, North Carolina.

2nd Have you a record of your age and if so where is it?

   I have not a record. My information relating to my age is such as is
   derived from my parents.

Where were ypu living when called into service? Where have you lived since
the Revolutionary War and where do you now live?

I was living in Rowan County in the State of North Carolina, form north
Carolina I removed to Virgina lived there five or six years from there
removed to South Carolina Pendleton County lived about five years from there
came to Kentucky Bourbon County lived there about eighteen years from thence
to Indiana does not recollect in what year thinks sbout fourteen years and
now I reside in the County of Warrick and State of Indiana.

4 How were you called into service, were you drafted, did you volunteer or
were you a substitute for whom?

   I was drafted the first tour then volunteered and then enlisted for twelve
   months called as a volunteer at many other times does not recollect the
   length of time and has forgotten the name of the person for whom he
   substituted.

5. Sate the names of some of the regular officers who you were with you. the
troops where you served, such Continental and Militia Regiments as you can
recollect, and the general circumstances of your service.

I recollect General Green, Colonel Washington, General Morgan being sometimes
with us. I do not recollect the name of any regiment but was in Colonel
Fifer's and Colonel Coldwell's regiment. I was in Capt Neightons Company. I
was under Major Langham Twelve months and was discharged by him.

6. Did you ever receive a discharge from the service if so by whom was it
given and what became of it?

I recieved a discharge for each tour. the first I do not recollect who signed
it. The second by Capt. Neighton, the third by Major Langham, they are all
Lost. Thought them worthless.

7. State the names of persons to whom you are known in your present
neighborhood and can testify as to your charechter for veracity and belief of
your dervices as a soldier of the Revolution.

Will of Squire Osborn- Spencer Co., IN - Making void all other Wills

1. Will and bequeath to my beloved wife all the household and kitchen
furniture with one bay mare and buggy to have and to hold during her natural
life.

2. I will and bequeath to my beloved son, Caleb, the east half of the
south-east quarter of Sec. 34 in Twp. 7 south of range 7 west, containg 80
acres. I do also will and bequeath  to my son, Caleb, 80 acres of land, it
being west half of south-west quarter Sec. 35 in Twp. 7 south of Range 7
west, including my dwelling house, barn and orchard which said tract of land,
my son is to have. I also will one hundred dollars to my grandson, David
Osborn, which my son, Caleb, is to pay him at the age of twenty-one. If not,
the above land is bound for the sameand, if said David Osborn should die
before that time and without heirs of his body, the above named money reverts
to Caleb Osborn. I bequeath to my son, Daniel, the southeast half of the
southwest quarter of Sec. 35 in Twp. 7 south of Range 7 west containg 40
acres. I also Will and bequeath to my grandson David Osborn, one hundred
dollars to be paid by my son Daniel, when he becomes twenty-one years of age.
If not, the last named land is bound for same and if David Osborn should die
before that time without heirs of his body, the last sum of money reverts
back to my son, Daniel. I also will that all the above land will stand bound
for the maintenance of my beloved wife and my daughter, Melinda, during thier
natural life. I also Will and bequeath to my beloved daughter lucretia, one
note I hold on my son, James Osborn, in the amount of one hundred and
seventy-six dollars which will become due on the 26th day of December, 1855.
I also Will and bequeath to my beloved daughter, Lucretia, a certain colt and
one cow and bed and bedding. I also Will and bequeath to my son, Daniel,
another note that I hold on my son, James, for one hundred and seventy-six
dollars which will become due on the 26th of December, 1854 and Daniel is to
pay to my daughter seventy-six dollars of the last note collected. I also
will to my grandson, David Osborn, another note that I hold on my son, James
osborn, for one hundred and seventy-six dollars which will become due on the
26th of December, 1856. I alsoWill to my sons, Daniel and Caleb, all my
personal property not heretofore named in this will for the payment of
outstanding debts.

   History of Iowa County, Iowa, Union Historical Co., 1881

YOUNG, A. W.- Merchant, Millersburg.  The subject of this sketch was born in
Wythe county, Virgina, on the 9th of August, 1816, where he spent his early
youth.  When about twelve years of age his parents brought him to Knox
county, Ohio, where he was raised to manhood.  He learned the trade of
tanner and currier, and followed that avocation about 25 years.  In 1841
moved to Greenup Co. Kentucky, where he resided about two years; he then
went to Meigs Co. OH, and remained untill spring of 1844, when he returned
to Greenup Co. KY, and was married in May, 1844 to Miss Martha Osborn,
native of that County.  In the fall of 1849 came to Iowa and settled in
Washington Co. where he resided two years.  He then came to to this Co. and
settled on a farm near Millersburg to engage in the hotel business,
following that but a few months; he afterward engaged in the harness
business, which he continued about seven years; then embarked in the drug
trade, following that about one year and six months, and then commenced the
grocery trade, subsequently branched into a general merchandise
establishment, which he still conducts with considerable degree of success.

Will of James Osborn


In the name of God, Amen: I James Osborn, of the county of Greenup and the
State of Kentucky, Being of sound mind and disposing memory and knowing the
uncertainty of life, do hereby make, ordain & publish this as my last will
& testament in the manner & form as follows; to wit: 1st, I bequeath my soul
to Almighty God, who gave it & my body to dust from which it came.  2nd, It
is my will & desire that all my personal property & real estate, after my
death be sold at public sale.  The real estate consisting of a tract of land
where I now live and one tract of land in the State of Iowa and one tract of
land on Smith's Branch in Greenup Co., Kentucky.  The lands to be sold for
1/3 cash in hand, 1/3 to be paid in two years and the other 1/3 to be paid
in four years from date of sale.  And the purchasers shall give bonds with
approved personal security for the purchase money until the same is paid.
The bonds shall be made payable to my Executors herin-after appointed or
such of them as may qualify and act as such.  And said bounds shall bear
interest from the date of sale.  The personal property shall be sold at
public sale on a credit of six months and the purchasers shall give bonds
with good security and bearing interest from day of sale.  3rd, My Executors
or such of them as may act shall, after the sale of my real & personal
property, pay to my beloved wife, Sarah Osborn, one thousand dollars as her
share and deliver to her one bed, bedstead and its furniture.  4th, After my
death I desire to be decently buried by my wife, Margaret Osborn, and all
necessary expense for the same to be paid out of my estate. After which I
devise the remainer of my estate, monies, credits, bonds, claims & demands
due me shall be collected by my executors or such as may act as such and to
be, by my executors or such as may act, equally divided among my heirs but
there is to be sharted in the said division, or distribution, certain
advancements made to some of my heirs as herinafter shown, to wit: John
Osborn is to be charged with an advancement amounting to one hundred seventy
three dollars.  James Osborn is to be charged with an advancement amounting
to one hundred thirty dollars.  Mary Maglone is to be charged with
advancements amounting to eighty-nine dollars $ fifty cents.
Eliza young is to be charged with advancements amounting to forty dollars.
William Osborn is to be charged with advancements amounting to ten dollars.
Jane Ford is be charged with advancements amounting to forty-five dollars.
Lucinda Covert is to be charged with advancements amounting to two hundred
fifty-two dollars & fifty cents.  Melissa Bates is to be charged with
advancements amounting to thirty dollars.  Ashley Osborn is to charged with
advancements amountin to sixty seven dollars.  Sarepta McNeal is to be
charged with advancements amounting to twenty dollars.  America Fleming is
to be charged with advancements amounting to forty seven dollars.  Ellen
Osborn is to charged with cow, bed & furniturenow in her possession
amounting to eighty dollars.  5th, I herby constitute & appoint my respected
friends & neighbors, Benjamin Howland & Edward Brooks as Executors of this,
my last Will & Testament and herby request the county judge of Greenup Co.,
Kentucky not to require any bond of my said executors on either of them.
6th, If any one or more of my heirs shall fail to apply for their portion or
protition of my estate with in six years from the day of the sale of my
lands then such unclaimed shares are to be equally devided & paid over to my
remaining heirs or their hiers if any of them should before that time die.

I James Osborn, do make this Codicil to my fore-going Will & Testament to
wit: Since making my last Will & Testament I have advanced my daughter,
America Fleming, Seventeen Dollars in cash and one cow worth twenty five
dollars making the sum of forty two dollars which I direct be charged
againts her in addition to the forty seven dollars charged against her in my
Will.  I have also advanced to my daughter, Lucinda Covert, since making my
will, the sum of one hundred dollars which I direct shall be, with the sum
of two hundred fifty two dollars & fifty cents charged against her in my
Will, the full share of said Lucinda in my estate.  I have agreed with my
son Squire Osborn, that if he shall pay me sixty five dollars each year that
I may live, on the 1st day of January of each year, that he is after my
daeth, to have my home farm, memtioned, but in addition to the payment of
the said sum yearly to me, the said Squire Osborn shall pay to my son,
Nathan Osborn, the sum of four hundred dollars. Should said Squire Osborn
fail to make said payments yearly as herin set forth, then the lands is to
be sold as herin in my will directed and Squire Osborn is to be repaid what
ever amount he may have paid me in my life time under this agreement and
should said Squire Osborn pay said payments & also the four hundred dollars
directed to be paid to Nathan Osborn and get the land, is to be in full of
his share of my estate.  And if Nathan Osborn or his hiers receive the said
four hundred dollars it is to be in full of Nathan's share of my estate.
Squire Osborn has paid me the payments of sixty five dollars per year for
the years of 1867 and 1868.  Should Squire Osborn make the payments of sixty
five dollars per year to me during my life time as herin set forth, I direct
that no sale of the land be made as directed by my Will. In witness whereof,
I the said James Osborn, do subscribe my name this 2nd day of October, 1868

I, James Osborn, do make this additional Codical to my last Will and
Testament. In the additon to the amount to be charged against Ashley Osborn
in distribution of my estate, there is the sum of seventy three dollars
which is to be decuted from his share of my estate in addition to the other
charges against his share mentioned in my Will & Codicil heretofore made.
there is also to be charged against the hiers of Manoah Osborn, the sum of
one hundred dollars for boarding and clothing.  There is also to me charged
against Amanda Pierce, twenty dollars in cash.  In witness whereof I James

Know all men by these present that we whose names are undersigned being
heirs at law and represenatives of the estate of James Osborn, deceased,
of the county of Greenup and the state of Kentucky do hereby bind ourselves
our heirs or assigners______ finally and jointly to pay the sum of five
hundred dollars lawful money of the United States to be paid as follows, and
hereafter_______ as follows.

 Condition First
    1 That no suit shall be bought either ____ law equaly without first
      paying the bond to the party or parties thereby aggrieved.

 Condition Second
    That the will made by our father James Osborn, deceased shall be in
    all the cases the the law in the settlement of the said estate.

 Condition Third
    And that all titles to Seal Estate to which the said James Osborn

    in him and that all errors in said title shall be settled by us under
    the will.

 Condition Fourth
    That the deed made by James Osborn in his lifetime to Alanzo Covert the
    calls of which is incorrect is by us herein corrected.  And we do agree
    that the deed made by B.H. and W.P. Bennetts and their wives and of
    record in the clerks office of Greenup County.  We do hereby ratify and
    confirm to the said Alanzo Covert, And all the_______ distances of the
    said deed of Bennett and Bennett and their wives to Osborn.  We do
    hereby ratify and confirm as our title to Alanzo Covert and that the

been unable to ascertain where they are.  he has examined the record, and
finds thier interst under the will is not prejudiced by any of the pleading

Making the amount found agst. the Adm. is the share of the _________
entitled to receive the assets found and offering for distribution by the
Will of James Osborn decd.  Three of his___________ Nathan & Squire Osborn
and Lucinda Covert _______ ________ with special bequests and _____ not to

charged to Ashley Osborn & John Osborn exceed their shares of the estate,
consequently the said Ashley & the heirs of said John, receive none of said
assets.  This leaving the above named nineteen to receive the assets in the
________ stated above. But the Administrator A.G. Duprey has _______ _____
the said Chs Osborn by the sum of 27 17/100, for this sum said A.G. Duprey
shall have judgement agst said Charles Osborn ___ _____ him for it.  Nothing

Davidson produced and filed his affidavit & that of B.H. Bennett ______

that suit.  The matter is dismissed from this suit.  The death of Silas
Osborn is by amended petition which is ordered to be filed suggested and the

I Owen McGlone, being sound in mind and in a disposible_______ ans certain of
the certainty of death, and the uncertainty of life do by these present, make
and ordain my last will and testement, which is as follows to wit.  1st I
will that After my just debts and funeral expenses are all paid I do bequeath
and will unto my beloved wife, Polly McGlone, all my real and personal
Estate, during her life time with the following conditions, as follows. After
my Deceased, I give and bequeath unto my son John McGlone, one dollar and no
more, to be paid out of my estate. I bequeath to my grandchildren heirs of Wm
McGlone, deceased son, thew following sums of money to wit. Elizabeth Jordad,
heir of Wm McGlone dc., one dollar and no more. 2nd Sally Yannin(?), One
Dollar and no more. 3rd Nancy Logan, one dollar and no more. 4th Alfred
McGlone, one dollar and no more. 5th John McGlone, one dollar and no more.
6th Martha Mcglone, one dollar and no more. 7th Jemina McGlone, one dollar

McGlone, the sum of one dollar and no more. I will and bequeath unto my son
Ambrose McGlone the sum of one dollar and no more. Now the foregoing sums
attached to the names of my heirs aret to be paid out of my estate to them by
my Executor herein aftyer named, and after the death of my beloved wife,
Polly McGlone, the remaing of my estate both real and personal, I further
will and bequeath unto my son James McGlone all the balance of my estate both
personal and real that may be left after the death of my dear wife, Polly
McGlone, as I owe James McGlone my son more than that will amount to for his
services to me as my dutiful son. I do hereby appoint and ______ my son James
McGlone to act as trustee_______ and do and provide for my dear wife Polly
McGlone while she lives, as I have full confidence in Him. This is the only
request from me.

I do hereby appoint James McGlone my Executor of my last will and
testement.
